The Opportunity
For more than 70 million Americans, flexible spending accounts (FSAs) and health savings accounts (HSAs) help reduce their taxable income and pay for everyday health costs like co-payments for doctor’s visits, surprise medical bills, and thousands of qualified medical products that consumers use every day. But the current definition of what constitutes a “qualified medical expense” has not kept up with the needs of consumers and public health at large.
Start with vitamins and supplements
Millions of Americans turn to daily multivitamins, targeted nutritional supplements and more to boost their overall wellness and treat a wide range of potential health conditions. But for the 70+ million Americans who have a flexible spending account (FSA), or health savings account (HSA), most vitamins and supplements are notably absent from FSA and HSA eligibility. This is just one example of the gaps that exist in tax-free healthcare coverage, and the first priority of Tax-Free Better to safeguard American consumers.
Expand IRS Definition of “Prevention”
IRS 213(d) defines qualified medical care (FSA/HSA eligibility) as, “amounts paid for the diagnosis, cure, mitigation, treatment, or prevention of disease or for the purpose of affecting any structure or function of the body.” Americans are active and engaged healthcare consumers and not willing to wait until there is “imminent probability of disease” to fix a problem. They want to take every step possible to manage and reduce their healthcare costs. This narrow definition of prevention no longer matches the reality of the world we live in.
That Sounds Problematic. Right?
Luckily, there’s a solution. We as taxpayers can make an impact if we speak up and ask Congress and the IRS to address our concerns. Pro-FSA/HSA legislation has a much better chance of passing with broad public support.
