A bipartisan bill, the Dietary Supplements Access Act (HR 4794) was introduced in July 2023 in the United States House of Representatives by Representative Darrin LaHood (R-IL), and co-sponsored by Representatives Brendan Boyle (D-PA), John Curtis (R-UT), and Josh Gottheimer (D-NJ). The bill, if made law, would make vitamins and other dietary supplement products FSA and HSA eligible. For the millions of Americans who rely on these products to manage their health, this is a step in the right direction.
A similar bill was also introduced in the Senate by Senator Kevin Cramer (R-ND) in October 2023. S. 3172 would make over-the-counter dietary supplement products FSA & HSA eligible.

A bipartisan bill has been introduced in the House of Representatives aimed at expanding FSA and HSA eligibility to include over-the-counter oral health products. HR 8533, if passed into law, will allow over-the-counter oral health products such as toothbrushes, water flossers, and other anticaries, antiplaque, and anti-gingivitis drug products to be purchased using FSA and HSA funds.
